PERSONAL DATA PROTECTION TERMS

PHẠM VI ÁP DỤNG
SCOPE OF APPLICATION

• Điều Khoản này áp dụng đối với hoạt động xử lý dữ liệu cá nhân của các chủ thể dữ liệu (sau đây gọi là “Khách Hàng” hoặc “Chủ Thể Dữ Liệu”):
  These Terms apply to the processing of personal data of the following subjects (hereinafter referred to as the “Customer” or “Data Subject”):
  • Cá nhân sử dụng sản phẩm/dịch vụ, nền tảng, ứng dụng, website hoặc các kênh giao dịch do VietUnion cung cấp.
    Individuals who use products, services, platforms, applications, websites, or transaction channels provided by VietUnion.
  • Cá nhân thực hiện hoặc có liên quan đến giao dịch được xử lý thông qua hệ thống của VietUnion.
    Individuals who conduct, or are otherwise involved in, transactions processed through VietUnion’s systems.
  • Cá nhân có dữ liệu cá nhân được VietUnion xử lý trong quá trình thực hiện hợp đồng hoặc theo quy định pháp luật.
    Individuals whose personal data is processed by VietUnion in the course of contract performance or in accordance with applicable laws.
• Điều Khoản này là một phần không tách rời của các hợp đồng, thỏa thuận hoặc văn bản khác điều chỉnh mối quan hệ giữa VietUnion với Chủ Thể Dữ Liệu, Đối Tác hoặc Bên Thứ Ba (nếu có). Trường hợp có thỏa thuận riêng về xử lý dữ liệu cá nhân, thỏa thuận đó được ưu tiên áp dụng trong phạm vi không trái quy định pháp luật.
  These Terms form an integral part of any agreements, contracts, or other documents governing the relationship between VietUnion and the Data Subject, Partner, or Third Party (if any). Where a separate agreement on personal data processing exists, such agreement shall prevail to the extent it does not conflict with applicable laws.

GIẢI THÍCH TỪ NGỮ
DEFINITIONS

• Dữ liệu cá nhân: Là dữ liệu số hoặc thông tin dưới dạng khác xác định hoặc giúp xác định một con người cụ thể, bao gồm: dữ liệu cá nhân cơ bản và dữ liệu cá nhân nhạy cảm. Dữ liệu cá nhân sau khi khử nhận dạng không còn là dữ liệu cá nhân.
  Personal data: means digital data or information in other forms that identifies or helps identify a specific individual, including basic personal data and sensitive personal data. Personal data that has been de-identified shall no longer be considered personal data.
• Xử lý dữ liệu cá nhân: Là hoạt động tác động đến dữ liệu cá nhân, bao gồm một hoặc nhiều hoạt động như sau: thu thập, phân tích, tổng hợp, mã hóa, giải mã, chỉnh sửa, xóa, hủy, khử nhận dạng, cung cấp, công khai, chuyển giao dữ liệu cá nhân và hoạt động khác tác động đến dữ liệu cá nhân.
  Processing of personal data: means any operation performed on personal data, including one or more of the following activities: collection, analysis, aggregation, encryption, decryption, modification, deletion, destruction, de-identification, provision, disclosure, transfer, and any other activities affecting personal data.
• Đối Tác: Là cá nhân, tổ chức có phát sinh mối quan hệ hợp tác với VietUnion.
  Partner: means any individual or organization having a cooperative relationship with VietUnion.
• Bên Thứ Ba: Là cá nhân, tổ chức không thuộc VietUnion, có ràng buộc pháp lý với VietUnion và/hoặc Chủ Thể Dữ Liệu thông qua các hợp đồng, thỏa thuận hoặc cam kết khác liên quan đến hoạt động của VietUnion.
  Third Party: means any individual or organization that is not part of VietUnion but has a legal relationship with VietUnion and/or the Data Subject through contracts, agreements, or other commitments relating to VietUnion’s operations.

QUY ĐỊNH CHUNG
GENERAL PROVISIONS

• VietUnion xử lý dữ liệu cá nhân theo phạm vi, mục đích đã thông báo cho Chủ Thể Dữ Liệu và phù hợp với quy định của pháp luật. Việc xử lý dữ liệu cá nhân được thực hiện trên cơ sở đồng ý của Chủ Thể Dữ Liệu hoặc các căn cứ hợp pháp khác.
  VietUnion processes personal data within the scope, the purposes notified to the Data Subject and in compliance with applicable laws. The processing of personal data shall be carried out based on the consent of the Data Subject or other lawful bases as prescribed by law.
• Khi truy cập, đăng ký, sử dụng sản phẩm/dịch vụ hoặc giao kết hợp đồng với VietUnion, Chủ Thể Dữ Liệu/Đối Tác/Bên Thứ Ba được cung cấp thông tin về Điều Khoản này. Trường hợp pháp luật yêu cầu sự chấp thuận để xử lý dữ liệu cá nhân, việc im lặng hoặc không phản hồi không được coi là sự đồng ý.
  When accessing, registering for, using VietUnion's products and/or services, or entering into a contract with VietUnion, the Data Subject, Partner, or Third Party shall be provided with these Terms. Where the applicable laws require consent for the processing of personal data, silence or failure to respond shall not constitute consent.
• Trường hợp Khách Hàng/Đối Tác/Bên Thứ Ba (sau đây gọi là “Chủ Thể Cung Cấp”) cung cấp cho VietUnion dữ liệu cá nhân của bên thứ ba khác (bao gồm nhưng không giới hạn thông tin người đại diện theo pháp luật, vợ/chồng, cha/mẹ, con, anh/chị/em bên thụ hưởng, người thừa kế theo pháp luật, người được ủy quyền, đối tác, bên bảo đảm, người phụ thuộc, người liên hệ và/hoặc cá nhân khác của Chủ Thể Dữ Liệu), Chủ Thể Cung Cấp cam kết đã thực hiện nghĩa vụ thông báo và có căn cứ hợp pháp theo quy định pháp luật để cung cấp dữ liệu cho VietUnion xử lý theo các mục đích nêu tại Điều Khoản này.
  Where a Customer, Partner, or Third Party (hereinafter referred to as the “Data Provider”) provides VietUnion with the personal data of another Third Party (including, without limitation, the personal data of legal representatives, spouses, parents, children, siblings, beneficiaries, legal heirs, authorized representatives, business partners, security providers, dependants, emergency contacts, and/or other individuals related to the Data Subject), the Data Provider represents and warrants that it has fulfilled its notification obligations and has a lawful basis under the applicable laws to provide such personal data to VietUnion for processing for the purposes set out in these Terms.
  Chủ Thể Cung Cấp chịu trách nhiệm chứng minh căn cứ hợp pháp của việc cung cấp dữ liệu. VietUnion được quyền dựa trên cam kết của Chủ Thể Cung Cấp và không chịu trách nhiệm đối với việc cung cấp dữ liệu trái pháp luật, trừ trường hợp pháp luật có quy định khác hoặc lỗi thuộc trách nhiệm của VietUnion.
  The Data Provider shall be responsible for demonstrating the lawful basis for providing such data. VietUnion may rely on the Data Provider's representations and warranties and shall not be liable for any unlawful provision of personal data unless otherwise required by applicable laws or where such liability arises from VietUnion's fault.
• VietUnion áp dụng các biện pháp quản lý, kỹ thuật phù hợp để bảo đảm an toàn, bảo mật dữ liệu theo quy định pháp luật và các tiêu chuẩn, quy chuẩn về an toàn thông tin trong lĩnh vực tài chính và trung gian thanh toán.
  VietUnion implements appropriate organizational and technical measures to safeguard the security and confidentiality of data in accordance with the applicable laws, as well as applicable information security standards governing the financial and payment intermediary sectors.
  Trong trường hợp xảy ra sự cố lộ, mất hoặc truy cập trái phép dữ liệu cá nhân, VietUnion sẽ thực hiện biện pháp khắc phục và thông báo cho Chủ Thể Dữ Liệu, cơ quan nhà nước có thẩm quyền theo quy định pháp luật.
  In the event of any personal data breach, loss, or unauthorized access, VietUnion shall take appropriate remedial measures and notify the Data Subject, the competent state authorities in accordance with the applicable laws.
• Tùy từng trường hợp cụ thể, VietUnion có thể đóng vai trò là (i) Bên Kiểm Soát Dữ Liệu Cá Nhân; (ii) Bên Kiểm Soát và Xử Lý Dữ Liệu Cá Nhân; hoặc (iii) Bên Xử Lý Dữ Liệu Cá Nhân và thực hiện các quyền, nghĩa vụ tương ứng theo quy định của pháp luật hiện hành.
  Depending on the specific circumstances, VietUnion may act as: (i) a Personal Data Controller; (ii) a Personal Data Controller and Processor; or (iii) a Personal Data Processor, and shall perform the corresponding rights and obligations in accordance with applicable laws.
  Trường hợp VietUnion xử lý dữ liệu theo thỏa thuận với Đối Tác, việc xử lý được thực hiện theo phạm vi trách nhiệm và mục đích đã được các bên xác định, phù hợp với quy định pháp luật.
  Where the processing of data is carried out by VietUnion pursuant to an agreement with a Partner, such processing shall be limited to the scope of responsibilities and purposes agreed by the parties and shall comply with the applicable laws.

CÁC LOẠI DỮ LIỆU ĐƯỢC XỬ LÝ
TYPES OF DATA PROCESSED

Tùy thuộc vào mục đích xử lý, loại sản phẩm/dịch vụ được sử dụng và yêu cầu của pháp luật tại từng thời điểm, VietUnion chỉ thu thập và xử lý dữ liệu cá nhân trong phạm vi cần thiết để thực hiện mục đích tương ứng. Danh mục dữ liệu có thể bao gồm một phần hoặc toàn bộ các loại dữ liệu được quy định tại Điều Khoản này:
Depending on the purpose of processing, the type of products and/or services used, and the applicable legal requirements from time to time, VietUnion collects and processes personal data only to the extent necessary for the relevant processing purposes. The categories of data collected and processed may include some or all of the types of data specified in these Terms:

• Dữ liệu cá nhân cơ bản:
  Basic personal data:

  Bao gồm các dữ liệu cá nhân cơ bản theo quy định pháp luật, gồm nhưng không giới hạn: họ, chữ đệm và tên khai sinh, tên gọi khác (nếu có); ngày, tháng, năm sinh; ngày, tháng, năm chết hoặc mất tích; giới tính; quốc tịch; hình ảnh của cá nhân; số điện thoại, số định danh cá nhân, số hộ chiếu; thông tin liên hệ; thông tin nhân thân; thông tin về mối quan hệ gia đình; thông tin về tài khoản số và các thông tin khác gắn với một cá nhân hoặc giúp xác định một cá nhân cụ thể không thuộc phạm vi dữ liệu cá nhân nhạy cảm.
  Includes basic personal data as prescribed by applicable laws, including but not limited to: full name, middle name, and given name; other name(s) (if any); date of birth; date of death or declaration of missing status; gender; nationality; photographs or other images of the individual; telephone number; personal identification number; passport number; contact information; identity information; information relating to family relationships; digital account information; and any other information associated with, or capable of identifying, a specific individual that does not constitute sensitive personal data.

  Bao gồm các dữ liệu thuộc phạm vi dữ liệu cá nhân nhạy cảm theo quy định pháp luật, gồm nhưng không giới hạn: dữ liệu sinh trắc học, đặc điểm di truyền; dữ liệu về tội phạm, vi phạm pháp luật được thu thập, lưu trữ bởi các cơ quan thực thi pháp luật; vị trí của cá nhân được xác định qua dịch vụ định vị; thông tin truy cập tài khoản định danh điện tử; hình ảnh thẻ căn cước, thẻ căn cước công dân, chứng minh nhân dân; thông tin tài khoản, thẻ ngân hàng, lịch sử giao dịch; thông tin tài chính, tín dụng; dữ liệu về hoạt động và lịch sử giao dịch tài chính, thanh toán, chứng khoán, bảo hiểm; dữ liệu theo dõi hành vi trên không gian mạng và các dữ liệu khác theo quy định pháp luật cần áp dụng biện pháp bảo mật chặt chẽ.
  Includes sensitive personal data as prescribed by applicable laws, including but not limited to: biometric data; genetic data; information relating to crimes and violations of law collected and retained by competent law enforcement authorities; an individual's location determined through location-based services; access credentials for electronic identification accounts; images of identity documents, including identity cards, citizen identity cards, and national identity cards; bank account and payment card information, including transaction history; financial and credit information; data relating to financial, payment, securities, and insurance activities and transaction history; data tracking an individual's activities in cyberspace; and any other categories of data that, under applicable laws, require enhanced security measures.

• Dữ liệu phát sinh trong quá trình sử dụng:

  Bao gồm các dữ liệu phát sinh trong quá trình Khách Hàng truy cập, sử dụng sản phẩm/dịch vụ hoặc tương tác với hệ thống của VietUnion, bao gồm nhưng không giới hạn ở thông tin thiết bị, hệ điều hành, trình duyệt, địa chỉ IP, thông tin nhật ký hệ thống (log), cookie, dữ liệu phiên làm việc (session), mã định danh trực tuyến, mã định danh thiết bị, dữ liệu phân tích sử dụng dịch vụ và các công nghệ tương tự được sử dụng nhằm vận hành hệ thống, xác thực người dùng, bảo đảm an toàn, phòng chống gian lận, đo lường hiệu năng và cải thiện chất lượng dịch vụ (nếu có).
  Includes data generated in connection with the Customer's access to or use of VietUnion's products and/or services, or interaction with VietUnion's systems, including but not limited to device information, operating system, browser type, IP address, system logs, cookies, session data, online identifiers, device identifiers, service usage analytics, and similar technologies used for system operation, user authentication, security, fraud prevention, performance measurement, and service improvement, where applicable.

CÁCH THỨC THU THẬP DỮ LIỆU
METHODS OF DATA COLLECTION

VietUnion trực tiếp hoặc thông qua các bên khác có liên quan, có thể thu thập dữ liệu cá nhân của Chủ Thể Dữ Liệu từ nhiều nguồn đa dạng, bao gồm nhưng không giới hạn từ các nguồn sau:
VietUnion may directly or indirectly, through relevant third parties, collect personal data of Data Subject from various sources, including but not limited to the following:

• Thông qua các kênh/phương tiện thực hiện hoạt động cung ứng sản phẩm/dịch vụ từ VietUnion, bao gồm nhưng không giới hạn: website, ứng dụng trên thiết bị di động, các tương tác hoặc công nghệ thu thập dữ liệu tự động (thông qua chương trình định vị người dùng; những chương trình/trình duyệt ứng dụng tương tự khác như: flash cookies, pixel tags…); hệ thống chăm sóc khách hàng, đánh giá, xác thực, giám sát; hệ thống kết nối/truyền dẫn trên môi trường mạng giữa VietUnion và Chủ Thể Dữ Liệu/Đối Tác/Bên Thứ Ba.
  Through channels and means used for the provision of VietUnion's products and/or services, including but not limited to: websites; mobile applications; user tracking technologies; automated data collection technologies; flash cookies; pixel tags; Customer service systems; assessment, verification, and monitoring systems; and online connection and transmission systems between VietUnion and Data Subject, Partner, or Third Party.
• Thông qua việc khai báo trực tiếp từ Chủ Thể Dữ Liệu.
  Through information directly declared or provided by the Data Subject.
• Thông qua việc tiếp nhận dữ liệu từ Chủ Thể Cung Cấp.
  Through personal data received from the Data Provider.
• Từ các cơ quan nhà nước, cơ quan có thẩm quyền tại Việt Nam.
  From government agencies and competent authorities in Vietnam.
• Từ các nguồn khác mà pháp luật cho phép.
  From other sources permitted by applicable laws.

MỤC ĐÍCH XỬ LÝ DỮ LIỆU
PURPOSES OF DATA PROCESSING

VietUnion xử lý dữ liệu cá nhân nhằm phục vụ cho một hoặc nhiều mục đích sau:
VietUnion processes personal data for one or more of the following purposes:

• Cung cấp và vận hành sản phẩm/dịch vụ
  Provision and operation of products and/or services
  • Tiếp nhận, xác minh, đối chiếu, cập nhật thông tin; thực hiện nhận biết, xác thực Khách Hàng theo quy định pháp luật.
    Receiving, verifying, cross-checking, and updating information; conducting customer identification and authentication in accordance with legal requirements.
  • Thiết lập, duy trì và quản lý quan hệ với Khách Hàng; thực hiện các yêu cầu, hợp đồng hoặc thỏa thuận liên quan đến việc sử dụng sản phẩm/dịch vụ.
    Establishing, maintaining, and managing relationships with Customers; performing requests, contracts, or agreements relating to the use of products and/or services.
  • Thực hiện các hoạt động thanh toán, trung gian thanh toán, kết nối, xử lý và truyền dẫn dữ liệu giao dịch, đối soát, tra soát, quyết toán và/hoặc các nghiệp vụ có liên quan.
    Carrying out payment, payment intermediary, transaction connection, transaction data processing and transmission, reconciliation, investigation, settlement, and other related operational activities.
  • Liên hệ, hỗ trợ, chăm sóc Khách Hàng; gửi các thông báo cần thiết liên quan đến Ví Điện Tử, giao dịch, sản phẩm/dịch vụ và quyền lợi của Khách Hàng.
    Contacting, supporting, and providing customer care services; delivering necessary notices relating to e-wallet services, transactions, products and/or services, and Customer’s benefits.
  • Tiếp nhận và xử lý các yêu cầu, khiếu nại, tranh chấp theo quy định của pháp luật.
    Receiving and handling requests, complaints, disputes, and claims in accordance with applicable laws.
• Quản lý rủi ro, bảo đảm an toàn và tuân thủ pháp luật
  Risk management, security, and legal compliance
  • Đánh giá, quản lý rủi ro; phòng ngừa, phát hiện, điều tra và xử lý các hành vi gian lận, lừa đảo, rửa tiền, tài trợ khủng bố, tài trợ phổ biến vũ khí hủy diệt hàng loạt, vi phạm pháp luật hoặc các rủi ro có thể ảnh hưởng đến Khách Hàng, VietUnion và các bên liên quan.
    Assessing and managing risks; preventing, detecting, investigating, and handling fraud, deception, money laundering, terrorist financing, proliferation financing, legal violations, or other risks that may affect Customers, VietUnion, or related parties.
  • Bảo đảm an ninh, an toàn thông tin; bảo vệ hệ thống thông tin; giám sát, kiểm tra, khắc phục sự cố và duy trì hoạt động liên tục của VietUnion.
    Ensuring information security and cybersecurity; protecting information systems; monitoring, inspecting, remediating incidents, and maintaining the continuous operation of VietUnion's systems.
  • Thực hiện nghĩa vụ theo quy định pháp luật, yêu cầu của cơ quan nhà nước có thẩm quyền và các nghĩa vụ pháp lý khác của VietUnion.
    Complying with legal obligations, requests from competent authorities, and other legal responsibilities of VietUnion.

CUNG CẤP, CHIA SẺ DỮ LIỆU
DISCLOSURE AND SHARING OF DATA

• Việc cung cấp, chia sẻ dữ liệu cá nhân của Chủ Thể Dữ Liệu theo quy định của Điều Khoản luôn đảm bảo nguyên tắc: cá nhân, tổ chức chỉ sử dụng dữ liệu cá nhân cần thiết cho mục đích thực hiện các chức năng, công việc mà VietUnion chỉ định, hợp tác và/hoặc theo quy định của pháp luật.
  The provision and disclosure of the Data Subject's personal data under these Terms shall at all times be subject to the principle that any individual or organization may only use the personal data necessary for the purposes of performing the functions or activities assigned by, carried out in cooperation with, VietUnion, and/or as required by applicable laws.
• Nhằm thực hiện các mục đích xử lý dữ liệu quy định tại Điều Khoản này, VietUnion cần thiết cung cấp, chia sẻ dữ liệu cá nhân cho các bên có liên quan, bao gồm nhưng không giới hạn:
  For the purposes set out in these Terms, VietUnion may disclose and share personal data with relevant parties, including but not limited to:
  • Các tổ chức, cá nhân cung cấp sản phẩm/dịch vụ cho Chủ Thể Dữ Liệu/Đối Tác, có sử dụng dịch vụ trung gian thanh toán của VietUnion để hỗ trợ Chủ Thể Dữ Liệu/Đối Tác thực hiện thanh toán.
    Organizations and individuals that provide products and/or services to the Data Subject and/or Partner and use VietUnion's payment intermediary services to facilitate payments by the Data Subject or Partner.
  • Các Đối Tác/Bên Thứ Ba có quan hệ hợp tác, liên kết, phối hợp với VietUnion trong việc thực hiện hoạt động cung ứng sản phẩm/dịch vụ của VietUnion.
    Partners and/or Third Parties cooperating, affiliating, or coordinating with VietUnion in the provision of products and/or services.
  • Các tổ chức, cá nhân có liên quan đến các giao dịch thanh toán của Chủ Thể Dữ Liệu.
    Organizations and individuals involved in payment transactions conducted by the Data Subject.
  • Các tổ chức/cá nhân cung cấp/nhận cung cấp sản phẩm/dịch vụ cho VietUnion, bao gồm nhưng không giới hạn ở các dịch vụ công nghệ thông tin, tài chính, đào tạo, tư vấn, tài chính…
    Organizations and individuals providing products and/or services to, or receiving products and/or services from, VietUnion, including but not limited to information technology, financial, training, consulting, and other professional services.
  • Các tổ chức, cá nhân được được phân quyền, phục vụ hoạt động kinh doanh và vận hành của VietUnion.
    Organizations and individuals authorized by VietUnion to support its business operations and operational activities.
  • Các cơ quan nhà nước, cơ quan có thẩm quyền tại Việt Nam.
    Government authorities and competent state agencies in Vietnam.
  • Các chủ thể khác theo quy định pháp luật.
    Other entities as required or permitted by applicable laws.
• Trường hợp dữ liệu cá nhân được lưu trữ, xử lý hoặc chuyển giao ngoài lãnh thổ Việt Nam, VietUnion thực hiện theo quy định pháp luật và áp dụng các biện pháp cần thiết nhằm bảo đảm an toàn, bảo mật dữ liệu.
  Where personal data is stored, processed, or transferred outside the territory of Vietnam, VietUnion shall comply with applicable laws and implement necessary measures to ensure the safety and security of such personal data.

QUYỀN VÀ NGHĨA VỤ CỦA CHỦ THỂ DỮ LIỆU
RIGHTS AND OBLIGATIONS OF DATA SUBJECT

• Quyền của Chủ Thể Dữ Liệu bao gồm:
  Data Subject shall have the following rights:
  • Được biết về hoạt động xử lý dữ liệu cá nhân.
    To be informed of the personal data processing.
  • Đồng ý hoặc không đồng ý, yêu cầu rút lại sự đồng ý cho phép xử lý dữ liệu cá nhân.
    To consent, refuse, or request withdrawal of consent to the personal data processing.
  • Xem, chỉnh sửa hoặc yêu cầu chỉnh sửa dữ liệu cá nhân.
    To view, modify, or request modification of their personal data.
  • Yêu cầu cung cấp, xóa, hạn chế xử lý dữ liệu cá nhân; gửi yêu cầu phản đối xử lý dữ liệu cá nhân.
    To request provision, deletion, and restriction of personal data processing; to object to personal data processing.
  • Khiếu nại, tố cáo, khởi kiện, yêu cầu bồi thường thiệt hại theo quy định của pháp luật.
    To complain, denounce, initiate lawsuits, or claim damages according to the law.
  • Yêu cầu cơ quan có thẩm quyền hoặc cơ quan, tổ chức, cá nhân liên quan đến xử lý dữ liệu cá nhân thực hiện các biện pháp, giải pháp bảo vệ dữ liệu cá nhân của mình theo quy định của pháp luật.
    To request competent authorities or agencies, organizations, or individuals relevant to personal data processing to adopt solutions and measures to protect their personal data according to the law.
  • Các quyền khác theo quy định của pháp luật.
    Other rights provided under applicable laws.
• Nghĩa vụ của Chủ Thể Dữ Liệu bao gồm:
  Data Subject shall have the following obligations:
  • Tự bảo vệ dữ liệu cá nhân của mình.
    To protect their personal data.
  • Tôn trọng, bảo vệ dữ liệu cá nhân của người khác.
    To respect and protect the personal data of others.
  • Cung cấp đầy đủ, chính xác dữ liệu cá nhân của mình theo quy định của pháp luật, theo hợp đồng hoặc khi đồng ý cho phép xử lý dữ liệu cá nhân của mình.
    To adequately and accurately provide their personal data in accordance with applicable laws, contracts, or upon their consent to the processing of their personal data.

    To promptly notify VietUnion if the Data Subject becomes aware of or reasonably suspects that their personal data has been disclosed, compromised, or otherwise affected in a manner that may create risks during the use of products and/or services, or if the Data Subject becomes aware of any breach of personal data protection under these Terms.
  • Phối hợp với VietUnion, cơ quan nhà nước có thẩm quyền hoặc các bên liên quan trong trường hợp phát sinh các vấn đề ảnh hưởng đến dữ liệu cá nhân của Chủ Thể Dữ Liệu.
    To cooperate with VietUnion, competent state authorities, and/or relevant parties in the event of any issue affecting the Data Subject’s personal data.

    To regularly review updates published on VietUnion’s official website and/or application and comply with any amendments or updates (if any) to these Terms.

    To fulfill any other obligations prescribed by applicable laws.
• Việc thực hiện quyền của Chủ Thể Dữ Liệu được thực hiện theo Điều Khoản này, quy trình do VietUnion công bố trong từng thời kỳ và quy định pháp luật liên quan.
  The exercise of Data Subjects’ rights shall be carried out in accordance with these Terms, procedures announced by VietUnion from time to time, and applicable laws.
• Chủ Thể Dữ Liệu có thể thực hiện các quyền của mình theo thông tin tại Điều Khoản này hoặc trực tiếp trên nền tảng của VietUnion (nếu có) hoặc kênh khác. VietUnion sẽ xử lý yêu cầu hợp pháp, hợp lệ trong thời hạn luật định và có thể thu phí cung cấp thông tin theo chính sách của VietUnion (nếu có).
  Data Subject may exercise their rights in accordance with the information provided under these Terms, directly through VietUnion’s platform (if available), or via other channels designated by VietUnion. VietUnion shall process lawful and valid requests within the statutory time limits and may charge fees for the provision of information in accordance with VietUnion’s policies (if any).

RÚT LẠI SỰ ĐỒNG Ý VÀ/HOẶC YÊU CẦU XÓA, HỦY DỮ LIỆU CÁ NHÂN
WITHDRAWAL OF CONSENT AND/OR REQUEST FOR DELETION OR DESTRUCTION OF PERSONAL DATA

• Việc rút lại sự đồng ý và/hoặc yêu cầu xóa, hủy dữ liệu cá nhân của Chủ Thể Dữ Liệu không làm ảnh hưởng đến tính hợp pháp của hoạt động xử lý đã được thực hiện trước thời điểm VietUnion tiếp nhận yêu cầu.
  The withdrawal of consent and/or request for deletion or destruction of personal data by the Data Subject shall not affect the lawfulness of any processing activities carried out prior to VietUnion’s receipt of such request.
• VietUnion có thể từ chối toàn bộ hoặc một phần yêu cầu hoặc tiếp tục xử lý, lưu trữ dữ liệu cá nhân trong trường hợp pháp luật cho phép. Việc thực hiện các quyền nêu trên có thể ảnh hưởng đến khả năng VietUnion cung cấp hoặc tiếp tục cung cấp một phần hoặc toàn bộ sản phẩm/dịch vụ, tính năng có liên quan.
  VietUnion may refuse, in whole or in part, a request or continue processing and retaining personal data where permitted by applicable laws. The exercise of these rights may affect VietUnion’s ability to provide or continue providing certain products and/or services, or related functionalities.
• Đối với dữ liệu cá nhân được Chủ Thể Dữ Liệu chia sẻ cho VietUnion, bao gồm thông qua ứng dụng định danh quốc gia (VNeID) hoặc các nguồn hợp pháp khác, Chủ Thể Dữ Liệu có quyền rút lại sự đồng ý hoặc yêu cầu xóa/hủy dữ liệu theo quy định pháp luật và hướng dẫn của VietUnion hoặc đơn vị quản lý nguồn dữ liệu tương ứng.
  With respect to personal data shared by the Data Subject with VietUnion, including through the National Identification Application (VNeID) or other lawful sources, the Data Subject has the right to withdraw consent or request the deletion and/or destruction of such personal data in accordance with applicable laws and the guidance of VietUnion or the entity managing the relevant data source.

DATA RETENTION

• Dữ liệu cá nhân được lưu trữ trong khoảng thời gian cần thiết để thực hiện các mục đích đã thông báo hoặc theo quy định của pháp luật. Trong một số trường hợp, thời gian lưu trữ có thể được kéo dài để phục vụ đối soát, tra soát, giải quyết khiếu nại, tranh chấp, thực hiện nghĩa vụ pháp lý hoặc bảo vệ quyền, lợi ích hợp pháp của các bên liên quan.
  Personal data shall be retained for the period necessary to fulfill the purposes communicated to the Data Subject or as otherwise required by applicable laws. In certain circumstances, retention periods may be extended for purposes including but not limited to: reconciliation and verification; transaction investigation; complaint and dispute resolution; compliance with legal obligations; and protection of the lawful rights and interests of VietUnion and relevant parties.
• Khi hết thời hạn lưu trữ hoặc không còn căn cứ hợp pháp để tiếp tục xử lý, VietUnion sẽ xóa, hủy, ẩn danh hoặc áp dụng các biện pháp xử lý phù hợp theo quy định pháp luật.
  Upon expiration of the applicable retention period or when there is no longer a lawful basis for continued processing, VietUnion shall delete, destroy, anonymize, or otherwise process personal data in accordance with applicable laws.

BẢO VỆ CHỦ THỂ DỮ LIỆU ĐẶC BIỆT
PROTECTION OF SPECIAL DATA SUBJECT

• Đối với người chưa thành niên, người mất năng lực hành vi dân sự, người có khó khăn trong nhận thức, làm chủ hành vi hoặc người bị hạn chế năng lực hành vi dân sự, VietUnion thực hiện xử lý dữ liệu cá nhân theo quy định pháp luật.
  With respect to minors, persons who have lost civil act capacity, persons with cognitive or behavioral difficulties, and persons with limited civil act capacity, VietUnion shall process personal data in accordance with applicable laws.
• Trường hợp pháp luật yêu cầu phải có sự đồng ý hoặc xác nhận của người đại diện theo pháp luật, VietUnion có quyền yêu cầu cung cấp thông tin, tài liệu để xác minh tư cách trước khi thực hiện việc xử lý dữ liệu cá nhân hoặc giải quyết các yêu cầu liên quan.
  Where applicable laws require the consent or confirmation of a legal representative, VietUnion reserves the right to request information and supporting documentation necessary to verify such representative capacity before processing personal data or handling related requests.

HIỆU LỰC THI HÀNH VÀ SỬA ĐỔI
EFFECTIVENESS AND AMENDMENTS

1. Điều Khoản này có hiệu lực kể từ ngày được ghi nhận trong Điều Khoản.
   These Terms shall take effect from the effective date specified herein.
2. VietUnion có thể sửa đổi, bổ sung hoặc cập nhật Điều Khoản trong từng thời kỳ nhằm phù hợp với quy định pháp luật, hoạt động kinh doanh hoặc việc cung cấp sản phẩm/dịch vụ. Các nội dung cập nhật sẽ được thông báo hoặc công bố bằng hình thức phù hợp trên các kênh chính thức của VietUnion.
   VietUnion may amend, supplement, revise, or update these Terms from time to time in order to: comply with applicable laws; reflect operational requirements; support business activities; or improve the provision of products and/or services. Any amendments or updates shall be notified or published through appropriate channels officially designated by VietUnion.
   Việc Chủ Thể Dữ Liệu tiếp tục sử dụng sản phẩm/dịch vụ hoặc duy trì quan hệ pháp lý với VietUnion từ thời điểm Điều Khoản được ban hành được hiểu là các bên đã chấp nhận nội dung này.
   The Data Subject’s continued use of VietUnion’s products and/or services, or continued legal relationship with VietUnion from the date such amendments become effective shall constitute acknowledgement and acceptance of these Terms and any amendments thereto.
3. Điều Khoản này được lập bằng tiếng Việt và tiếng Anh. Trong trường hợp có bất kỳ khác biệt hoặc mâu thuẫn nào giữa hai phiên bản, phiên bản tiếng Việt sẽ được ưu tiên áp dụng.
   These Terms are executed in Vietnamese and English. In the event of any conflict, inconsistency, or discrepancy between the two versions, the Vietnamese version shall govern.
